These terms are the deal between you (the real estate professional holding the account) and REALsite, operated from Winnipeg, Manitoba, Canada. Creating an account means you accept them. We've written them to be read.

The service

REALsite provides your website, hosting, themes and design tools, MLS® listing sync, lead capture and CRM, email tools, and the rest of what the plan describes — one plan with every REALsite feature included. Optional third-party purchases such as domain registration and renewal are priced separately before checkout. We run the platform; the professional judgment, the client relationships, and the real estate belong to you.

Your content and your contacts

Everything you put in — your copy, photos, pages, and above all your leads and contacts — is yours. We host and process it to provide the service and for nothing else. You can export your contacts at any time, including on the way out. If you cancel, we'll remind you to export before your data is removed.

Email and CASL

You are the sender of every email your site and newsletter send on your behalf, and CASL's rules about consent apply to you. The platform helps you manage that responsibility with consent requests that include your sender details, records of the wording and identity shown when a contact opts in, unsubscribe links, sender details in commercial-email footers, and automatic suppression of opted-out and undeliverable addresses. You can stop marketing email for a contact, but only that contact can opt back in through your public site and confirm from their inbox. These are compliance-supporting tools, not legal advice or a guarantee that your contacts, content, or use of the service comply with CASL. You remain responsible for the lists you import and the messages you send, should obtain independent legal advice for your practices, and must not mail people without the consent or other lawful basis your business requires. Repeated abuse is grounds for us to suspend sending.

MLS® listing data

Listing data reaches your site through CREA's DDF® program under your own feed agreement with your board. That data belongs to the boards and their members; display rules apply, and if your feed authorization ends, the listings leave your site as the rules require. MLS® and REALTOR® are trademarks of The Canadian Real Estate Association.

AI features

Drafting tools produce suggestions from your own site's content. Nothing publishes without you; review anything AI-drafted before it goes out, the same way you'd review an assistant's work. You're responsible for what your site says.

Billing

The plan price, the free trial, and what's included are stated on the pricing page. Billing is monthly through Stripe; cancel any time and your site stays up through the period you've paid for. If a payment fails we'll tell you and retry before anything is interrupted.

Acceptable use

Don't use the platform for anything unlawful, deceptive, or harmful; don't misrepresent listings or licensure; don't attempt to breach other customers' data or the platform itself. We can suspend or terminate accounts that do, with notice where the situation reasonably allows it.

The honest disclaimers

We work hard to keep the service fast and available (see status.realsite.ca), and we take backups seriously — but no platform can promise perfection, and the service is provided "as is". To the extent Manitoba law allows, our total liability for any claim is capped at the fees you paid us in the twelve months before the claim arose, and we're not liable for indirect or consequential losses such as lost commissions. Nothing here limits liability that can't lawfully be limited.

Changes and governing law

If these terms change materially, account holders get an email before the change takes effect; continuing to use the service after that is acceptance. These terms are governed by the laws of Manitoba and the federal laws of Canada, and disputes belong to the courts of Manitoba.
